The Court of Arbitration for Sport (CAS) Romania’s Ana Barbosu is firm in her decision to finish third in floor exercise at the Paris Olympics.
The decision led the International Olympic Committee (IOC) to request the American gymnast Jordan Chiles Return the bronze medal that was originally awarded to her.
In a media release on Wednesday, CAS said it never disputed that USA Gymnastics (USAG) missed a one-minute deadline to challenge Cilis’s floor exercise score during hearings with Romanian and US officials.
The Olympic judges first revised Chiles’ score, elevating her to the bronze medal position, and ousting Barbosu from the podium.
“At trial, there is no dispute between the parties that Ms. Chiles’s questioning was officially submitted 1 minute and 4 seconds later. [sic] displayed on the scoreboard,” CAS He said At its publication.
“All parties have clearly and firmly accepted the report prepared by OMEGA, the official timekeeper for the Olympic Games, and submitted by the FIG. Neither party accepted the other evidence.
The USAG said it did not have access to the video, proving its investigation was submitted 47 seconds later.
“The video footage provided to USA Gymnastics prior to the court’s ruling was not available, so USAG did not have the opportunity to submit it prior to the court’s decision,” USAG said Sunday.
The United States Olympic & Paralympic Committee (USOPC) and USAG also now claim that CAS sent “critical communications” to the wrong email addresses, and as a result, the parties failed to properly prepare for the hearing.
“The USOPC strongly objects to the CAS decision due to significant procedural errors,” the USOPC told CNN on Thursday. “From August 6-9, CAS sent critical communications to erroneous email addresses at USOPC and USAG, and the error was not corrected until August 9 – three days after filing, two days past the deadline for submitting objections, and within 24 hours of the hearing.
“This deprived us of sufficient time to respond meaningfully or collect the necessary evidence. We immediately conveyed our objections to the CAS.
Both parties have said that they will continue to appeal the matter.
“Our truth-seeking efforts in this matter remain unwavering,” the USOPC said.
Chiles Took it to Instagram On Thursday she said she was “overwhelmed” by the outpouring of love and support.
“I am extremely grateful to my family, teammates, coaches, fans, USAG and the USOPC for their unwavering support during this difficult time,” he wrote.
“I have no words. “This decision feels unfair and is a significant blow not only to me, but to everyone who has succeeded in my journey,” Chiles continued. “I have poured my heart and soul into this sport and I am very proud to represent my culture and my country.”
“I will approach this challenge like anyone else – and make every effort to ensure that justice is done.”
On Monday, USAG said it will “pursue every possible avenue and appeals process, including the Swiss Federal Tribunal, to ensure proper scoring, placement and medal award for Jordan.”
Dr. Hamid G., who represented Romania in previous arbitration cases, chaired the CAS panel. The National Governing Council has also expressed concern over Kharavi. CAS says none of the parties objected to Caravi’s appointment to the board, but USAG says it was never informed of his ties to Romania.
“CAS has not forwarded any panelist’s conflict-of-interest disclosures to USA Gymnastics, nor have we seen the disclosures to date,” its statement said.
Last week, Chiles posted four breaking hearts emojis on her Instagram story, explaining how she was “taking this time to remove myself from social media for my mental health.”
